2. Statutory Definitions

6. Data Principal Rights
Under the DPDPA 2023, you are recognized as the Data Principal and hold the following rights:
a. Right to Access: You have the right to obtain information about the Personal Data we hold about you and how it is being processed.
b. Right to Withdrawal: You may withdraw your consent for future calls or emails at any time by notifying us at info@afcindia.in. Withdrawal of consent shall not affect the lawfulness of any processing performed prior to such withdrawal.
c. Right to Correction/Completion/Updation: You may request corrections to any inaccurate, incomplete or outdated data.
d. Right to Erasure: Upon the fulfillment of the inquiry purpose or withdrawal of consent, you may request the deletion of your personal identifiers from our active communication databases (subject to legal retention requirements).
e. Right to Nomination: You may nominate another person to exercise your rights in the event of your death or incapacity.
f. Right to Grievance Redressal: You may raise a grievance regarding the processing of your data (see Section 7 below).
7. Grievance Redressal Mechanism
We have established an effective grievance redressal mechanism. You may submit any grievance relating to the processing of your Personal Data to our Grievance Officer at info@afcindia.in.
We will acknowledge your grievance within 5 working days and endeavour to resolve it within 30 days. If you are not satisfied with the resolution or do not receive a response within the prescribed time, you may complain to the Data Protection Board of India in the manner prescribed under the DPDPA.
8. Personal Data Breach Notification
In the event of a Personal Data Breach, AFC will notify the Data Protection Board of India within such time as may be prescribed under applicable law and the affected Data Principals without undue delay, in accordance with Digital Personal Data Protection Act, 2023 and any rules, regulations, or directions issued thereunder.
9. Disclosure and Third-Party Limitations
- Non-Disclosure: We do not sell or trade your personal data to third-party marketing entities.
- Service Providers: Data may be shared with secure service providers solely to maintain Website availability or server integrity. Such sharing is governed by contracts that require the Data Processors to comply with the DPDPA and implement appropriate security safeguards.
